Privacy Policy

Privacy is very important to the Straight Up Partners. We have created this privacy policy (the “Privacy Policy”) to explain learn more about the ways in which we use and protect your personal information. Please also read it to learn about how we treat the information collected and received from you through your use of the Website and Services.

Except as set forth in this Privacy Policy and elsewhere in our Terms of Use and other published guidelines, we do not release personal information about our users without their permission.

This Privacy Policy applies only to the Website, and we are not responsible for the practices of persons, companies, institutions, or websites that the Straight Up Partners do not control, manage, or employ. It forms part of the Terms of Use for the Services and Website. Capitalized terms not defined herein have the meanings ascribed to them elsewhere in the Terms of Use.

Information Covered by this Privacy Policy

Some of our Website’s functionality can be used without revealing any personal information. In these cases, the only information we collect will be “Non-Personal Information”, i.e., information that cannot be used to identify you. Non-Personal Information includes information such as the web pages that you have viewed.

However, accessing many of the Services through the Website requires you provide some additional information in order to sign in and/or register. In these cases, you may need to submit “Personally Identifiable Information” (i.e., information that can be used to identify you). Personally Identifiable Information can include information such as your name and email address, among other things. You are responsible for ensuring the accuracy of the Personally Identifiable Information you submit through the Website. Inaccurate information may affect your ability to use the Website, the information you receive when using the Website, and our ability to contact you. For example, your email address should be kept current because that is one of the primary manners in which we communicate with you.

What You Consent to by Using Our Website

By submitting any Personally Identifiable Information to us, you consent and agree that we may collect, use, disclose and retain such Personally Identifiable Information in accordance with this Privacy Policy and other parts of these Terms of Use, and as permitted or required by law.

If you do not agree with these terms, then please do not provide any Personally Identifiable Information to us. If you refuse or withdraw your consent, or if you choose not to provide us with any required Personally Identifiable Information, we may not be able to provide you with the services that can be offered on our Website.

The Information We Collect and How We Use It

We gather two types of information about users through the Website:

Non-personal information

We use any Non-Personal Information we collect in aggregate form to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users, and by measuring demographics and interests regarding specific areas of our Website.

When users come to our Website, we may track, collect and aggregate Non-Personal Information indicating, among other things, which pages of our Website were visited, the order in which they were visited, when they were visited, and which hyperlinks were “clicked.” We may also collect information from the URLs from which you linked to our Website. Collecting such information may involve logging the IP address, operating system and browser software used by each user of the Website. Although such information is not Personally Identifiable Information, it may be possible to determine from an IP address a user’s Internet Service Provider and the geographic location of his or her point of connectivity.

We also use or may use cookies and/or web beacons to help us determine and identify repeat visitors, the type of content and sites to which a user of our Website links, the length of time each user spends at any particular area of our Website, and the specific functionalities that users choose to use. Essentially, cookies are a user’s identification card for the servers on which the Website is hosted. Web beacons are small graphic files linked to our servers that allow us to track your use of our Website and related functionalities. Cookies and web beacons allow the Straight Up Partners to serve you better and more efficiently, and to personalize your experience at the Website. Cookies and web beacons are not used to retain Personally Identifiable Information. From time to time we may also use additional typical methods of collecting data.

You should be able to control how and whether cookies will be accepted by your web browser. Most browsers offer instructions on how to reset the browser to reject cookies in the “Help” section of the toolbar. If you reject our cookies, many functions and conveniences of this Website may not work properly.

Personally Identifiable Information

You voluntarily share Personally Identifiable Information about you when you sign in and/or register to use the Services (either using registration forms on the Website or through “Social Login”, a process described later in this Privacy Policy), when you provide email or other contact information to comment on the website, when you sign up through the website for a mailing list, when you get in touch with us through email or a contact form, when you respond to a survey, or when you otherwise contact or send information or feedback to us.

Among other things, we may use the Personally Identifiable Information that you provide to respond to your questions, provide you the specific Services you select, send you updates about Services or events we offer, and send you email messages about Website maintenance or updates.

Except as set forth in this Privacy Policy or as specifically agreed to by you, the Straight Up Partners will not disclose to others any Personally Identifiable Information we gather from you on the Website.

Social Login

The Website uses Social Login for your convenience, e.g. so you can register and sign in to the Website without creating a new username and password. When using Social Login, you will be taken to the authentication and sign in tools provided by your existing social provider(s), such as Google, Facebook, or other third party websites and providers. These third party providers are not supposed to share your password under any circumstances. They do share your email address and they usually share your name. We do not control what information is shared with us, however, meaning that we will also receive any other profile information you approve for them to share with us. The Straight Up Partners will not use Personally Identifiable Information we receive from you in this way for any purposes except those set forth in this Privacy Policy.

Verification of Your Educational Status

If you are a registered student or educator at an educational institution, the Straight Up Partners may offer you the ability to receive access to additional services. In order to subscribe to these additional services, you may be required to provide us with additional Personally Identifiable Information such as proof that you work or study at that educational institution, e.g. in the form of your valid email address hosted by that institution. Personally Identifiable Information and any other information we receive from you for this purpose will be used to validate your educational status, and may be archived and used for future communications with you

Participation in Online Courses

From time to time, the Straight Up Partners may offer you the opportunity to participate in an online course on or through the Website. If you desire to participate in a course, you will be asked to provide us with or confirm certain information necessary to conduct such a course. This information may include, among other things, your name and email address. The Straight Up Partners, or their third party service providers, may, for instance, collect certain information from you in conjunction with assignments, exams and other assessments related to the online course. For example, as part of a course, the Straight Up Partners (or their third party service providers) may collect certain information from you in order to (a) verify or authenticate your identity or submissions made by you, such as a signature for a test or assignment log, a photograph or recording of you (e.g., using a webcam) or information included on a photo identification card or document, or (b) monitor your performance during an exam to confirm that you are abiding by the applicable test rules or requirements (e.g., confirming that you are not using prohibited resources). The Straight Up Partners may also collect information from you or about your performance or accomplishments related to the course, such as quiz/exam scores, grades, project evaluations, teacher evaluations and other evaluations of your performance or accomplishments.

We may share Personally Identifiable Information that we collect from you when you participate in an online course with the particular educational partner (e.g., such as a university or company) that is using the online course as part of its programming and the instructor(s) who taught, managed or otherwise oversaw that programming. For example, if you are taking a course through a university, we may share Personally Identifiable Information about you and your performance with the university to report on your progress in the course. In another example, if you are taking a course sponsored or paid for by your employer, we may share your grades, evaluations, or progress in the course with your employer and other Personally Identifiable Information. Personally Identifiable Information shared with our educational partners will be subject to the privacy policies and procedures of such partners. Also, we may archive this information and/or use it for future communications with you.

Recommendations Made to Us

A user of the Website might provide your name and email address through a recommendation form on the Website, i.e. they may use the form to recommend that we let you know about the Website and Services. If this happens we will use this Personally Identifiable Information to send you an email on their behalf, we will copy them on that email, and we will not send you any further correspondence unless you request it. The Personally Identifiable Information they share will be stored so that we can track for any abuses of the recommendation process and remove abusing users from our system.

Providing Services to You

When you use certain services that are available on or through the Website, you may be required to provide us with Personally Identifiable Information. For example, we may make available to you chat room services that allow you to communicate with staff members. When you use such services, you may send us Personally Identifiable Information, and we may archive this information and/or use it for future communications with you. Moreover, in certain circumstances, we may share certain information and materials with third parties in order to provide you services that you have requested. For example, we provide a service that allows you to share word of certification you received through open badging services. This would only be done at your request.

Purchases

When purchasing products or services through the Website or its online shop, you may be required to provide us with Personally Identifiable Information, such as your name, address, billing information (i.e., credit card information and billing address) (“Billing Information”), shipping address, and email address. Third Party Websites

We may receive Personally Identifiable Information when you access or sign in to a third party website, e.g., Facebook, from our Website. This may include the text and/or images of your Personally Identifiable Information available from the third party website. To the extent such Personally Identifiable Information contains images of you, you grant the Straight Up Partners a limited, non-exclusive right to use, reproduce, distribute, prepare derivative works of or publicly display such images and/or your likeness for promotion or fundraising. An example of this might be if your image shows up in a screen shot or video shared in a presentation we give to potential funders. We may also receive an image or likeness of you when you access or sign in to our Website using Social Login, e.g. a profile or avatar image. We may use the Personally Identifiable Information collected from third party websites for internal purposes. An example of this might be if such an image becomes associated with your profile on our Website.

Disclosure to our Business Partners

The Straight Up Partners may share Personally Identifiable Information with third party business partners, such as companies that may be offering products or services or other opportunities that may be of interest to you, but only after obtaining your consent.

Disclosure to Service Providers

Our operations and maintenance contractors and other service providers may have limited access to your Personally Identifiable Information in the course of providing products or services to us. These contractors may include vendors and suppliers that provide us with technology (e.g. hardware, information technology, or website), services (e.g., test proctoring services), and/or content related to the operation and maintenance of the Website or the online courses. Access to your Personally Identifiable Information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function for us.

Government Authorities, Legal Rights and Actions

The Straight Up Partners may share your Personally Identifiable Information with various government authorities in response to subpoenas, court orders, or other legal process; to establish or exercise our legal rights or to protect our property; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us. We also may share your Personally Identifiable Information when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of the Straight Up Partners, the Website, our users, customers, or others; and in connection with our Terms of Use and other agreements.

Disclosure to Acquirers

The Straight Up Partners may disclose and/or transfer your Personally Identifiable Information to an acquirer, assignee or other successor entity in connection with a sale, merger, or reorganization of all or substantially all of the equity, business or assets of the Straight Up Partners to which your Personally Identifiable Information relates.

Third Party Tracking

Third parties, including linked sites and applications (e.g., Facebook and YouTube), customer support services and data analytics services, may collect information about you in connection with your use of the Website (e.g., usage information). Such third parties may use tracking technologies in connection with the Website, which may include the collection of information about your online activities over time and across third-party web sites or online services. In some cases, third party tracking tools may only collect Non-Personal Information about your use on the Website. However, in other cases, such third parties may collect Personally Identifiable Information about you as they engage in these activities (e.g., customer support services may obtain your name and email address in conjunction with their support activities).

Currently, we do not monitor or take any action with respect to Web browser signals or other mechanisms for the expression of choice regarding collection of information about an individual over time and across third-party web sites or online services (e.g., Web browser “do not track” signals).

External Links

For your convenience we may provide links to websites operated by companies other than the Straight Up Partners (“Third Party Sites”) that we believe may be of interest to you. We do not disclose your Personally Identifiable Information to these Third Party Sites without obtaining your consent. Licence Agreement

Making top quality tools and resources available to as many people as possible is very important to The Straight Up Partners. We have created this License Agreement to explain the ways in which we do this through the Website and Services. Please read it to learn more about the ways in which you can use the intellectual property to which you have access.

This License Agreement forms part of the Terms of Use for the Services and Website. Capitalized terms not defined herein have the meanings ascribed to them elsewhere in the Terms of Use.

Our Openly Licensed Intellectual Property

Through the Website, the Straight Up Partners make some of their intellectual property available for free through a Creative Commons License (our “Openly Licensed IP”). Our intent in doing this is to increase the accessibility of high quality tools and approaches for creativity, innovation, and entrepreneurship around the world.

Openly Licensed IP includes that which can be accessed through the Website without signing in, i.e. what is available on the Website to the general public. It also includes that which can be accessed on the Website by signing in but without paying any fee, i.e. what is available to users who sign in to the Website but who have not paid a fee. The details and implications of this license are outlined in this section.

Openly Licensed IP does not include intellectual property that requires payment of a fee to be accessed, i.e. if you have to pay a fee then the corresponding intellectual property is licensed to you as described in the section below on our Regularly Licensed IP.

Our Open Creative Commons License

Our Openly Licensed IP is made available through the Creative Commons Attribution-NonCommercial-NoDerivs license linked below in this section. This license means that users of the Website are allowed to read, download, and share the materials they have access to with others, as long as they provide appropriate credit to the Straight Up Partners and the author(s) of the materials, and as long as they don’t change them in any way or use them commercially.

Here is the license deed: http://creativecommons.org/licenses/by-nc-nd/2.5/ca/

And here is the full legal code in English: http://creativecommons.org/licenses/by-nc-nd/2.5/ca/legalcode.en

And here is the full legal code in French: http://creativecommons.org/licenses/by-nc-nd/2.5/ca/legalcode.fr

Our Regularly Licensed Intellectual Property

Through the Website, The Straight Up Partners make some of their intellectual property available for a fee (“Regularly Licensed IP”). Regularly Licensed IP corresponds to intellectual property that requires payment of a fee to be accessed, i.e. if you have to pay a fee then this license applies. It often corresponds to our mini courses, courses, and WEE Degrees.

We reserve all rights to our Regularly Licensed IP. This means that users of the Website are allowed to read, study, and refer others to the materials as long as they provide appropriate credit to the Straight Up Partners and the author(s) of the materials. They may only use them for their own personal non-commercial purposes.

Interpretation of “Non-commercial”

The term NonCommercial in the above Creative Commons license and the term non-commercial in the above regular license and mean that users may not sell, profit from, or commercialize intellectual property found in materials on the Website, or in works derived from them. The guidelines below are intended to help users determine whether or not their use of materials found on the Website would be permitted under the “non-commercial” restriction. Note that there are additional requirements spelled out in the Creative Commons license (such as attribution and no derivatives).

1. Commercialization is prohibited. Users may not directly sell or profit from materials found on the Website or from works derived from materials found on the Website without making alternative arrangements in writing with the Straight Up Partners.

Example: A commercial education or training business may not offer courses based on materials found on the Website if students pay a fee for those courses and the business intends to earn revenue through doing so.

Example: An educational institution may not offer workshops based on materials found on the Website if workshop participants pay a fee for those workshops and the institution intends to earn revenue through doing so.

Example: A consultant may not offer workshops or other consulting services based on materials found on the Website if clients pay a fee for those services and the consultant intends to earn revenue through doing so.

2. Determination of commercial vs. non-commercial purpose is based on the use, not the user. Materials found on the Website may be used by individuals, institutions, governments, corporations, or other business whether for-profit or non-profit so long as the use itself is not a commercialization of the materials or a use that is directly intended to generate sales or profit.

Example: A corporation may use materials found on the Website for internal professional development and training purposes.

3. Incidental charges to recover reasonable reproduction costs may be permitted. Recovery of nominal actual costs for copying small amounts (under 100 copies) of materials found on the Website on paper is allowed for educational purposes so long as there is no profit motive and so long as the intended use of the copies is in compliance with all license terms. Students must be informed that the materials are freely available on the Website and that their purchase of copied materials is optional.

Example: An institution in a remote area has limited Internet access and limited network infrastructure on campus, and a teacher offers to print copies of materials found on the Website relevant to her course. The teacher may recover the costs of creating the printed copies.

If you have questions about acceptable use of materials found on the Website, please contact our Copyright Agent »
